Observatoriet informerer om fire nye publikationer

Identifikation og analyse af malware på udvalgte websteder, som mistænkes for at krænke ophavsrettigheder.
Observatoriet skriver:  Some websites and mobile applications illegally share copyright protected content publicly, sometimes even free of charge and without any registration. Along with this content, the websites commonly distribute various kinds of malware and potentially unwanted programs (PUPs), luring users into downloading and launching these files. These programs use deceptive techniques and social engineering — such as empty game installations and ostensibly ‘useful’ software — to trick end users into disclosing their sensitive information.”

Undersøgelse om lovgivningsforanstaltninger vedrørende onlinekrænkelser af intellektuelle ejendomsrettigheder.
Observatoriet skriver: Intellectual property right infringement, particularly in the online environment, has not only been rising in volume but also in complexity. To counter such online infringement a diverse set of legislative measures, known either as legal instruments applied normally in the physical world or targeted specifically in the online environment, are available throughout the Member States.

The intention of the present study is to provide a cross-sectorial view of legal remedies available for the enforcement of intellectual property rights on the internet, which covers civil, administrative and criminal enforcement measures.”

Observatoriet skriver: “The Baseline of Trade Secrets Litigation in the EU’, a report commissioned by the EUIPO, examines the current level of trade secrets litigation, as well as the profiles of parties involved and the courts dealing with trade secrets matters.”

Observatoriet skriver: “Over the course of a number of studies, findings have emphasised that specialisation is recommended only in jurisdictions which meet a certain set of economic, societal and institutional prerequisites.  In order to reap the full benefits of specialisation, the judges’ expertise needs to be developed and maintained through continuous training.”
